Prenup Agreements
As a prenup lawyer, we can create pre-nuptial agreements for couples that are about to get married.
This may not seem very romantic, but it may be sensible. For example, if either party wants to protect assets for their children from a previous relationship, or protect assets that they have inherited.
Prenups are not strictly binding on the court if there is a later divorce, but will be followed unless unfair.
To help the prenup lawyer to draw up agreements that are as strong as possible, there should be full financial disclosure.
And the prenup agreement should be prepared well in advance of the wedding to avoid the suggestion of undue pressure.

Prenup & Postnup: A Case Study
Problem
My client’s previous marriage had resulted in acrimonious and costly divorce proceedings. He wished to protect his assets for his adult children as he had considerable property and a large pension, so approached us to be his prenup lawyer.
Solution
Both my client and his new wife-to-be had been married before and they wanted clarity should the marriage end. The wedding was in two months, giving enough time for both to provide the other with full financial disclosure, and for them both to obtain independent legal advice and ask us, as their prenup lawyer, to create a draft agreement.
Outcome
The agreement was prepared and signed well in advance of the wedding. On the day of the wedding both were pleased that all their children could be reassured that the marriage was not about any financial gain.

Will a prenup or postnup affect spousal maintenance decisions?
An agreement can set out intentions around spousal maintenance, including whether ongoing financial support should be paid and for how long. While the court always retains discretion, clear and fair provisions are often taken seriously, particularly where both parties received independent advice from experienced family solicitors.
Can we use the same solicitor, or do we both need separate advice?
Each partner must receive independent legal advice for an agreement to carry weight. This protects both parties and helps avoid future disputes.
