Increasingly, one of the areas we are seeing a number of same sex couples approach us about is co-habitation agreements. As fewer people are getting married, more and more couples are simply moving in together, and quite often the individual people in the relationships may have assets they wish to protect.
A cohabitation agreement simply ensures that each partner’s assets are protected. This is an area of law which is currently under review, with a campaign taking place to protect the legal rights of cohabiting couples. Shockingly 46% of the British population mistakenly believe in the common-law marriage myth. Until there is a change in the law there is currently no common law marriage protection!
